1. Acceptance of Terms
By accessing or using uptimeMonit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
uptimeMonit provides uptime monitoring, status pages, SSL certificate monitoring, and related services for websites, APIs, and online services. Features and availability may vary by plan.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old or the age of majority in your jurisdiction.
- One person or entity may not maintain more than one free account.
4. Acceptable Use
You agree not to:
- Use the Service to monitor endpoints you do not own or have permission to monitor.
- Attempt to overwhelm or abuse monitored targets through excessive check frequencies.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Resell or redistribute the Service without prior written consent.
- Use the Service for any illegal or unauthorized purpose.
5. Payment and Billing
- Paid plans are billed in advance on a monthly or annual basis.
- All fees are non-refundable except as required by law or as stated in our refund policy.
- We reserve the right to change pricing with 30 days' notice. Existing subscriptions will honor the current price until the next renewal.
- If payment fails, we may suspend access to paid features after a grace period.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of any data you submit to the Service. We will not access your monitored endpoints for any purpose other than performing the monitoring you have configured.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. Planned maintenance windows will be communicated in advance. For uptime commitments, please refer to our Service Level Agreement.
8. Limitation of Liability
To the maximum extent permitted by law, uptimeMonit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.
10. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes take effect constitutes acceptance of the revised terms.
